Agroindustrial Association of Ukraine / Arbitral court
In 2015 a permanent Court of Arbitration was established and registered under the Agroindustrial Association of Ukraine.
The task of the of Arbitration Court is to protect the economic and moral rights and legal interests of individuals or legal entities through a comprehensive review and resolution of disputes in accordance with the law.
In comparison with economic legal proceedings, consideration of economic disputes in the Arbitration Court is characterized by less formalism, a shorter time and the absence of a number of inconsistencies which inherent in the economic court.
Arbitrators are highly qualified specialists in the field of consideration of economic disputes related to the execution of contracts agricultural market. Their competence allows quickly and efficiently, in accordance with the current legislation of Ukraine, to settle all kinds of disputes between the parties. For example it allows restore the mutually beneficial cooperation between manufacturers, suppliers and buyers.
The amount of court costs in cases in the Arbitration court is much less than the amount of the state fee which must be paid at the time of filing a claim in the economic court. Thus, according to the law of Ukraine "On profit tax" and the Rules of the Arbitration Court the Arbitration collection amount included in gross costs of the enterprise after the decision in the case and charged with defeated party.
Arbitration Court under the Association is the non-independent permanent body, formed by the decision of the General Meeting of the Association for the resolution of disputes arising from civil and economic relations, and operates according to the Law of Ukraine "On arbitration courts", Regulations Standing Arbitration Court at the Association "Agroindustrial Association of Ukraine" and the Statute of the court of Arbitration.
